1. Acceptance of Terms

By downloading, accessing, or using the MioWords mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MioWords ("we," "us," or "our"). Your continued use of the App signifies your acceptance of any updates or modifications to these Terms.

2. Description of Service

MioWords is a language learning application that provides:

• Daily vocabulary lessons with meanings, examples, and audio pronunciation
• Interactive quizzes including fill-in-the-blank exercises
• AI-powered pronunciation practice with real-time feedback and scoring
• Progress tracking with streaks, statistics, and performance analytics
• Word library with search, filter, and bookmark capabilities
• Multi-language support across 30+ languages

The App is available on iOS devices and requires an internet connection for full functionality.

4. Subscription Plans and Payments

4.1 Free Tier

MioWords offers a free tier with access to basic features, including:

• Limited daily words
• Basic quiz functionality
• Limited pronunciation practice

Free tier features are subject to limitations and may change at our discretion.

4.2 Premium Subscription

Premium subscriptions unlock full access to all features, including upto 5 daily words, advanced quizzes, repetition pronunciation practice, and detailed analytics.

Subscription Details:

• Billing frequency – Available as monthly or annual subscriptions
• Payment processing – All payments are processed through Apple In-App Purchase
• Automatic renewal – Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• Pricing – Current subscription prices are displayed in the App and may vary by region

4.3 Managing Your Subscription

To manage or cancel your subscription:

1. Open iOS Settings on your device
2. Tap your name at the top
3. Select Subscriptions
4. Choose MioWords
5. Tap Cancel Subscription

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.

4.4 Refund Policy

All purchases are final. We do not offer refunds for partial subscription periods. However, you may request a refund directly from Apple:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find your MioWords purchase and request a refund

Refund approval is at Apple's sole discretion and subject to their policies.

4.5 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect existing subscriptions until renewal. We will notify you of price changes in advance.

5. Acceptable Use and User Conduct

You agree to use MioWords responsibly and in compliance with all applicable laws.

5.1 Prohibited Activities

You agree NOT to:

1. Violate laws – Use the App for any illegal purpose or in violation of local, state, national, or international law
2. Hack or disrupt – Attempt to gain unauthorized access, interfere with, or disrupt the App's servers, networks, or security measures
3. Share accounts – Allow others to use your account or share login credentials
4. Reverse engineer – Decompile, disassemble, or attempt to derive the source code of the App
5. Scrape or copy content – Use automated tools to extract or copy content from the App
6. Abuse features – Exploit bugs, glitches, or vulnerabilities for unfair advantage
7. Impersonate others – Falsely represent yourself as another person or entity
8. Distribute malware – Upload or transmit viruses, malware, or harmful code

5.2 Consequences of Violations

Violation of these terms may result in immediate suspension or termination of your account without refund, and we may pursue legal action if necessary.

6. Intellectual Property Rights

6.1 Our Content

All content, features, functionality, and materials in the App, including but not limited to:

• Text, vocabulary, definitions, and example sentences
• Graphics, logos, icons, and images
• Audio recordings and pronunciation guides
• Software code, algorithms, and AI models
• Design, layout, and user interface

are owned by MioWords and protected by copyright, trademark, patent, and other intellectual property laws. All rights are reserved.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial language learning purposes only. This license does not permit you to:

• Reproduce, distribute, or publicly display our content
• Create derivative works based on the App
• Use the App for commercial purposes without written permission

6.3 User-Generated Content

Any feedback, suggestions, or ideas you provide to us become our property, and we may use them without compensation or attribution.

7. Disclaimers and Limitation of Liability

7.1 "As Is" Service

MioWords is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, error-free, or secure service
• Accuracy, reliability, or completeness of content
• Results or outcomes from using the App

7.2 Limitation of Liability

To the maximum extent permitted by law, MioWords and its affiliates, officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the App
• Unauthorized access to or alteration of your data

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

7.3 Educational Tool Disclaimer

MioWords is an educational tool designed to assist with language learning. We do not guarantee fluency, proficiency, or specific learning outcomes. Your results depend on your effort, consistency, and other factors beyond our control.

8. Account Termination

8.1 Termination by You

You may delete your account at any time by:

1. Opening the MioWords app
2. Going to Profile → Edit Profile
3. Scrolling down and tapping Delete Account
4. Confirming your decision

Account deletion is permanent and irreversible. All your data will be deleted within 30 days.

8.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Use
• Your account is used for fraudulent or illegal activities
• We are required to do so by law
• We discontinue the App or service

Termination does not entitle you to a refund for any unused subscription period.

9. Changes to These Terms

We may modify these Terms at any time to reflect changes in our practices, legal requirements, or business operations.

When we make material changes:

• We will update the "Last updated" date at the top of this page
• We will notify you via email or in-app notification
• Your continued use of the App after changes constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the App and delete your account.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MioWords operates, without regard to conflict of law principles.

10.2 Dispute Resolution

If you have a dispute with us, please contact us first at [email protected]to attempt to resolve the issue informally. Most concerns can be resolved quickly through direct communication.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MioWords regarding your use of the App.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations under these Terms without restriction.
